Maker

A Maker is a person who enjoys making, tinkering, or exploring ideas in a hands on way. Makers range from amateur enthusiasts to professional experts in their field.

By signing up for http://www.makersmakingchange.com (the “Website”), the Maker is agreeing to volunteer their time, skills and expertise to 3D print, laser cut, solder, build, or assemble a project for a Person with a Disability or a Disability Professional. How much time and energy the Maker wants to volunteer and the type of projects they take on is self determined. The Maker is not responsible for the cost of materials or shipping.

By signing up as a Maker, there is no guarantee that there will be Build Requests in your region. Depending on the size of your region, you may not have many People with Disabilities or Disability Professionals signed up for  the “Website“. If you would like to assist in building the presence of Makers Making Change in your region, you can become a Community Champion

Makers: Searching for Projects

The Maker can search their local area by typing in their town or city in the search bar of the Connect page of the “Website“.  If there are no Build Request in the local area, try zooming out on the map and click Search This Area to refresh the search. If there is still not a Build Request found locally, a Maker can browse the Project Library and if there is a project they feel confident in making, they can click I Can Make This. In this case, if a Person with a Disability or a Disability Professional requires a build in other regions, the Maker will be paired with a long distance Build Request.

Build Requests are made by a Person with a Disability or a Disability Professional and are listed on the map as a teal pin along with the user profile photo and the name of the item requested. Makers can also submit their own project designs to the Project Library by clicking “Submit a Build” in their user profile.

Maker User Expectations

The Maker is responsible for replying to Build Requests that come directly through the Connect section of the “Website” to their email. The first interaction is recorded in the back end of the “Website,” and will be sent to the Maker, the Regional Coordinator in your area, and the Website Administrator. Any interactions beyond the first connection are between the two parties. When responding to a Build Request, the Maker is responsible for discussing the timeline, cost of materials, expectations, and your availability for future repairs. This should be discussed before agreeing to or declining a build request. It is recommended that the Maker provides a list of materials and shipping costs to the Person with a Disability or Disability Professional, and have them sign off on it to avoid any misunderstandings that may occur.

By signing up for http://www.makersmakingchange.com (the “Website”) the Maker is agreeing to have their profile photo and skills viewed by all users in the Connect page of the “Website” and will be indicated with a red pin on the map.

Person with a Disability

A “Person with a Disability” is a person who has a physical or mental impairment that limits their ability to participate in activities such as work or daily routines.

A Person with a Disability can browse the Project Library and Request a Build from a Maker through the Connect page of the “Website“.  A Person with a Disability can also Submit an Idea for a device they want built that is not currently in the Project Library.

By signing up for http://www.makersmakingchange.com (the “Website”), the Person with a Disability can Request a Build of one or several projects in the Project Library. If a Person with a Disability Requests a Build, there is no guarantee that the project will be fulfilled. Depending on the size of your region, you may not have sufficient Makers available or signed up for the “Website“. If you would like to assist in building the presence of Makers Making Change in your region, you may become a Community Champion.

How much time and energy the Maker wants to volunteer and the type of projects they take on is self determined. The Maker is not responsible for the cost of materials or shipping.

Person with a Disability: Requesting a Build

The Person with a Disability can search their local area by typing in their town or city in the search bar of the Connect page of the “Website“. If there are no Build Request in the local area, they can zoom out on the map and click Search This Area to refresh the search. If there is still not a Build Request found locally, a Person with a Disability can browse the Project Library and if there is a project they want, click I Want This. In this case, the Website Administrator and Regional Coordinator will attempt to pair the Person with a Disability with a Maker for a long distance Build Request.

Person with a Disability User Expectations

By signing up for http://www.makersmakingchange.com (the “Website”), a Maker is agreeing to volunteer their time, skills and expertise to 3D print, laser cut, solder, build, or assemble a project for a Person with a Disability or a Disability Professional.

How much time and energy the Maker wants to volunteer and the type of projects they take on is self determined, so the Maker can accept or decline a Build Request based on their comfort level, skills, available time, or personal discretion.  The Person with a Disability is responsible for the cost of materials and shipping of a project (if applicable).

The Person with a Disability is responsible for making the initial contact with a Maker through the Connect page of the “Website“.  Each project in the Project Library has a list of skills required for the build.

There are two ways to submit a Build Request:

a) The Person with a Disability can submit a Build Request for one or several projects in the Project Library by searching the Connect page for a Maker who has the skills required for the build. The Person with a Disability can contact with a Maker directly by clicking the Connect button, then filling out the Build Request form.

b) A Build Request can also be made through the User Profile page by filling out the Build Request form, however it will not be connected to a particular Maker. 

The first interaction is recorded in the back end of the “Website,” and will be sent to the Regional Coordinator in your area and the Website Administrator. Any interactions beyond this first interaction is between the two of you. When responding to a Build Request, the Maker is responsible for discussing the timeline, cost of materials, and expectations and your availability for future repairs. This should be discussed before agreeing to or declining a build request. The Maker is responsible for providing a list of materials and shipping costs for the Person with a Disability or Disability Professional to sign off on, to avoid any misunderstandings that may occur.  It is also expected that the Maker communicates their willingness and ability to service or repair the project over a longer period of time.

Once a project has been delivered from a Maker to a Person with a Disability, the Person with a Disability indicates the project has been delivered by going to their user Profile, and clicking Fullfilled next to the Build Request.

Disability Professional

A Disability Professional can be an Assistive Technologist, Occupational Therapist, or anyone who works with or advocates on behalf of People with Disabilities as their profession. Disability Professionals can refer their clients to the “Website” or directly Connect with a Maker to Request Builds from the Project Library. Disability Professionals can Request a Build on behalf of clients or for use at their clinic or centre. Most importantly, they are also invited to provide Reviews and feedback via surveys. This feedback allows Makers Making Change to improve the Project Library.

Makers Making Change is a unique project in that it is the only project of its kind to include and value the feedback of Disability Professionals based on their professional opinions and advanced knowledge of assistive devices. By participating in reviews and feedback surveys, Disability Professional are playing a role in innovating the entire Assistive Technology field in order to provide affordable alternatives to commercially available Assistive Technology to low income individuals.

Disability Professional; Requesting a Build

The Disability Professional can search their local area by typing in their town or city in the search bar of Connect page of the “Website“. If there are no Build Request in the local area, they can zoom out on the map and click Search This Area to refresh the search. If there is still not a Build Request found locally, a Disability Professional can browse the Project Library and if there is a project they want, can click I Want This. In this case,the Web Admin and Regional Coordinator will attempt to pair the Disability Professional with a Maker for along distance Build Request.

Person with a Disability: User Expectations

Once a project has been delivered from a Maker to a Disability Professional, the Disability Professional indicates the project has been delivered going to their user Profile and clicking Fullfilled next to the Build Request.

Acceptance

By using or visiting the website located at http://www.makersmakingchange.com (the “Website”), or by using any software provided by Neil Squire Society, you agree to the terms and conditions set out in these Website Terms of Use and also the terms and conditions contained in the Website’s Privacy Policy, available at http://www.makersmakingchange.com/privacy-policy which is incorporated herein by reference. If you do not agree to any of these terms, please do not use the Website. These Terms of Use apply to all users of the Website, including users who use the Website to:

  • search for available products and services;
  • provide information, and creative content to the Website and its users;
  • advertise or offer products or services.

Accessing the Website

Neil Squire Society grants you permission to use the Website in accordance with these Terms of Use, provided that:

  • you use the Website only for your persona
  • personal use or for a non-personal use that is allowed under these Terms of Use;
  • you will not copy or distribute any part of the Website in any medium or manner inconsistent with these Terms of Use without Neil Squire Society’s prior written consent;
  • you will not alter or modify any part of the Website except as may be reasonably necessary to use the Website for its intended purpose; and
  • you will otherwise comply with these Terms of Use.

In order to access some of the Website’s features, you will need to create an account. You may never use another person’s account without permission. When creating your account, you must provide accurate and complete information. You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify Neil Squire Society immediately of any breach of security or unauthorized use of your account. Although Neil Squire Society will not be liable for your losses caused by any unauthorized use of your account, you may be liable for Neil Squire Society’s losses caused by such unauthorized use.

Neil Squire Society reserves the right to establish data transfer restrictions and to limit the total amount of data transfer associated with your account. Neil Squire Society may close a user account if it determines in its sole discretion that the total amount of that account’s data transfer is excessive.

You agree not to use or launch any automated system, including without limitation, “robots,” “spiders,” “offline readers,” etc., that accesses the Website in a manner that sends more request messages to the Neil Squire Society’s servers in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser. Notwithstanding the foregoing, Neil Squire Society grants the operators of public search engines permission to use spiders to copy materials from the Website for the sole purpose of creating publicly available searchable indices of the Website’s materials, but not caches or archives of such materials. Neil Squire Society reserves the right to revoke these exceptions. You agree not to collect or harvest any personally identifiable information, including account names, from the Website.

In order to view or access certain materials on the Website, or post or publish User Submissions on the Website, you may be required to download and install certain software. For these limited purposes only, you are hereby granted a revocable non-exclusive licence to use the software provided by Neil Squire Society for the sole purpose of accessing the applicable features on the Website. Neil Squire Society makes no warranty concerning the functionality of such software on any individual computer and you agree that Neil Squire Society will not be liable for any problem which may be caused to your computer or damage that you may incur as a result of your use of such software. You hereby waive any legal or equitable rights or remedies you may have against Neil Squire Society with respect to your installation or use of such software.

Intellectual property rights

Except for User Submissions, the Website, its design and all its content, including the software, scripts, graphics, photos, sounds, music, videos, and interactive features (“Content“) and the trademarks, trade names, service marks and logos contained therein (“Marks“), are owned by or licensed to Neil Squire Society, subject to copyright and other intellectual property rights under Canadian law and international conventions. Content on the Website is provided to you “as is”, for your information and personal use only and may not be used, copied, reproduced, distributed, displayed, sold, or otherwise exploited for any other purposes whatsoever without Neil Squire Society’s prior written consent and if applicable, payment of the owner’s licence fee. Neil Squire Society reserves all rights not expressly granted over the Website and Content. You agree not to use, copy, or distribute any of the Content other than expressly permitted herein, including any use, copying, or distribution of any third party User Submissions obtained through the Website. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict persons from using or copying any Content or that enforce limitations on people’s use of the Website or the Content thereon.

User Submissions

The Website may permit you and other users to submit text, audio, video or other communications (“User Submissions“) and may host, share, and publish such User Submissions. User Submissions may include, without limitation:

  • private messages from user to user;
  • publicly posted communications viewable by all users or certain specified users;
  • user profiles;
  • educational, informational, or promotional, or other communications;
  • requests for products, services or information;
  • offers to provide products, services or information;
  • hyperlinks to products, services, information, advertisements, and third party content; and
  • design plans which may include schematics, 3D model files, assembly instructions, assembly diagrams, software code and supporting documentation.

Neil Squire Society may also establish categories for User Submissions based on intended use, such as “Private” for User Submissions which are not shared, “Invited” where there is an invitation to view and/or share and “Public” for material that is publicly accessible. You understand that whether or not such User Submissions are published and regardless of category, Neil Squire Society does not guarantee any confidentiality with respect to any such submissions. You also understand and agree that Neil Squire Society may place advertising on the Website in conjunction with User Submissions.

You are solely responsible for your own User Submissions and the consequences of posting or publishing them. For all User Submissions you submit which are intended for public use, you represent and warrant that:

  • you own or have the necessary licenses, rights, consents, and permissions to use and authorize Neil Squire Society to use all copyrights, trademarks, trade names, service marks, logos and intellectual property and other proprietary rights in and to any and all of your User Submissions, which are necessary to enable Neil Squire Society to include and use those User Submissions on the Website in the manner contemplated by these Terms of Use;
  • each and every identifiable individual person in the User Submission has given you their consent or permission to use their name or likeness and to include and use them in your User Submissions in the manner contemplated by these Terms of Use; and
  • any advertisement, business solicitation, or other representation complies with the laws of British Columbia and the laws of Canada applicable therein.

You retain all of your ownership rights in your User Submissions. However, by submitting the User Submissions to Neil Squire Society for use on the Website, you hereby grant Neil Squire Society a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Submissions in connection with the Website and Neil Squire Society’s operations, including without limitation for promotion and redistribution of part or all of the Website’s content (and derivative works thereof) in any media formats and through any media channels. You also hereby grant each user of the Website a non-exclusive license to access your User Submissions, if submitted for public or semi-public use, through the Website, and to use, reproduce, distribute, prepare derivative works of, display and perform such User Submissions as permitted through the functionality of the Website and under these Terms of Use.

For User Submissions that you submit, you further agree that you will not:

  • submit material that is copyrighted, protected by trademark or otherwise subject to third party proprietary rights, including privacy and publicity rights, unless you are the owner of such rights or have permission from their rightful owner to post the material and to grant Neil Squire Society all of the license rights granted herein;
  • publish falsehoods or misrepresentations that could damage Neil Squire Society or any third party;
  • submit material that is unlawful, obscene, defamatory, libelous, threatening, pornographic, harassing, hateful, racially or ethnically offensive, or encourages conduct that would be considered a criminal offence, give rise to civil liability, violate any law, or is otherwise inappropriate;
  • post any advertisements, business solicitations, or other representations that may mislead a user or other third party about the products, services or information being offered; or
  • impersonate another person.

Neil Squire Society does not endorse any User Submission or any opinion, recommendation, or advice expressed therein, and Neil Squire Society expressly disclaims any and all liability in connection with User Submissions. Neil Squire Society will remove all Content and User Submissions if properly notified that such Content or User Submission infringes another’s intellectual property rights, may reasonably mislead another user or third party about the facts expressed in that User Submission, or otherwise violates these terms of Use. Neil Squire Society also has the sole discretion to decide whether Content or a User Submission is appropriate and complies with these Terms of Use as concerns pornography, obscene or defamatory material, or excessive length. Neil Squire Society reserves the right to remove Content and User Submissions without prior notice and to terminate a User’s access to the Website if that User is in violation of these Terms of Use. Neil Squire Society reserves the right to remove any content or discontinue any aspect of the services provided on its Website at any time and within reasonable timeframes.

YOU ARE SOLELY RESPONSIBLE FOR YOUR INTERACTIONS WITH OTHER USERS OF THE WEBSITE. YOU UNDERSTAND THAT NEIL SQUIRE SOCIETY DOES NOT CONDUCT CRIMINAL BACKGROUND CHECKS, SCREENINGS OR MAKE OTHER INQUIRIES ABOUT USERS OF THE WEBSITE, AND THAT NEIL SQUIRE SOCIETY DOES NOT REVIEW OR VERIFY THE STATEMENTS OF ITS USERS. NEIL SQUIRE SOCIETY DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES AS TO THE CONDUCT OF USERS OF THE WEBSITE, USER SUBMISSIONS OR USER OFFERS.

Neil Squire Society reserves the right to conduct criminal background checks or other screenings at any time using available public records.

Neil Squire Society is not responsible for the conduct of any user of the Website. In no event shall Neil Squire Society be liable, whether directly or indirectly, for any losses or damages arising in relation to your use of the Website or your access to any User Submission or User Offer, including without limitation general, special, compensatory, consequential, exemplary, punitive, statutory or other damages for, without limitation, bodily injury, emotional or mental distress, personal injury, death, economic loss, loss of opportunity, or any other damages.

You agree to take all necessary precautions and to conduct your own independent review of any User Submissions and User Offers and other content available on the Website before relying on any statements, representations or offers contained therein.

You understand that when using the Website, you will be exposed to User Submissions from a variety of sources, and that Neil Squire Society is not responsible for and makes no warranties concerning the accuracy, usefulness, safety, or intellectual property rights of User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable, and you hereby waive any legal or equitable rights or remedies you may have against Neil Squire Society with respect to those User Submissions.

Third party websites

The Website may contain links to third party websites that are not owned or controlled by Neil Squire Society, and Neil Squire Society assumes no responsibility for those third party websites. By using the Website, you expressly discharge Neil Squire Society from any and all liability arising from your use of any third-party website.

Accuracy of information

We rely on the information you provide through the Website, including registration information (name and email address), payment information (credit card numbers and expiration dates), and transaction-related information, which must be true, accurate, current and complete. You will be solely responsible and liable for any and all loss, damage, and additional costs that you, we or any other person may incur as a result of your submission of any false, incorrect or incomplete information or your failure to update your registration information and payment information within 30 days of any change.

Website User Submissions offering products and services

The Website permits users to offer to provide products and services to other users, directly, throughout advertisements, by hyperlinking to third party websites, and through other means (each a “User Offer”).  User Offers are User Submissions for which the offering user (each offering user is, in this context, a “Maker”) is solely and completely responsible.  User Offers are not reviewed by Neil Squire Society in the ordinary course of its operations.

As a Maker, you agree that you will not use the Website to communicate a User Offer that:

  • breaches any applicable law, rule, or regulation in any applicable jurisdiction;
  • violates any contractual rights, proprietary rights, or other legal rights of another user or third party;
  • may mislead a user or other third party about the products, services or information being offered;
  • may result in harm to another user, a third party or the interests of Neil Squire Society; or
  • is determined by Neil Squire Society in its sole discretion to be an unreasonable, offensive or improper use of the Website.

Neil Squire Society may investigate and take any available legal action in response to any illegal or unauthorized use of the Website.

Warranty and Indemnity

You agree that your use of the Website is at your sole risk. Neither Neil Squire Society nor any Maker makes any warranty concerning bugs, viruses, Trojan horses or similar problems which may be transmitted to or through the Website by any third party, or concerning damage of any kind incurred resulting from visiting or using the Website. Neil Squire Society does not endorse and is not responsible for any product or service advertised or offered by a user or third party through the Website or any hyper-linked website.

In no event shall Neil Squire Society, its officers, directors, employees, volunteers or agents or any Maker with which you interact be liable to you for any direct, indirect, incidental, special, punitive or consequential damages resulting from any claim, injury or damage that you incur because of your use of the Website, any Content, any User Submission, or Neil Squire Society’s software.

You agree to defend, indemnify and hold harmless Neil Squire Society and its officers, directors, employees, volunteers and agents and/or any Maker with which you interact, from any and all claims, damages, obligations, losses, liabilities, costs, debts and expenses (including but not limited to legal fees) arising from:

  • your use of and access to the Website;
  • your violation of any aspect of these Terms of Use;
  • your violation of any third party right, including without limitation any copyright, property, or privacy right; or
  • any claim that one of your User Submissions caused damage to a third party.

The above indemnifications will survive these Terms of Use and will continue after you end your use of the Website.

Direct Sales from Neil Squire Society

Pricing policy

Neil Squire Society operates the Website as part of the Makers Making Change Initiative with the goal of improving the lives of persons with disabilities. As part of this goal, Neil Squire Society attempts to improve access to and reduce the cost of products and services that can improve the quality of life of persons with disabilities.  To accomplish this, Neil Squire Society offers some products and services using a dynamic pricing policy, with prices that may be different from the prices that are charged for those products and services by other sellers.  Neil Squire Society’s pricing will comply with all applicable laws and regulations, but it may be significantly different from standard market rates.

Additional factors may also affect the products, services and prices available from Neil Squire Society. The selection, availability and prices of online products and services and effective sales dates may differ by geographic region and place and manner of sale. Due to differences in effective sales dates across the country, items may be available online at a discounted sale price in some locations only, or in some locations before others. In addition, market conditions and competitive pressures may cause prices and availability to change without further notice. Please also note that although great care is taken in the production of the Website, typographical, illustrative or pricing errors may occur. We reserve the right to correct errors at any time.

All prices quoted are payable in Canadian dollars and do not include shipping charges and, unless otherwise stated, do not include GST, PST, QST or HST.

With respect to items sold by Neil Squire Society, we cannot confirm the price of an item until you order. However, WE DO NOT CHARGE YOUR CREDIT CARD OR OTHER SOURCE OF FUNDS UNTIL AFTER YOUR ORDER HAS ENTERED THE SHIPPING PROCESS. Despite our best efforts, a small number of the items offered on the Website may be mispriced. If an item’s correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before shipping or cancel your order and notify you of that cancellation.

The Website may offer limited-time sales values, special sales and regularly priced items. The “regular prices” shown are the standard prices at which Neil Squire Society sells the displayed products as of the indicated date. Your order will be deemed to be accepted only when Neil Squire Society sends a confirmation email to the email address you provided. Please include your order number in the body of your email OR Please have your order number ready when you place your call.

Neil Squire Society reserves the right to limit quantities, reject, correct, cancel or refuse orders, and to terminate accounts, in its discretion, including, without limitation, if Neil Squire Society believes that a customer’s conduct is based on a material misrepresentation, violates the law, or is harmful to the interests of Neil Squire Society or any third parties.

Acknowledgement

In certain situations, some jurisdictions prohibit persons from excluding certain warranties and limiting certain liabilities. These statutory prohibitions may apply to you, and Neil Squire Society acknowledges that in that case, parts of these Terms of Use will not be binding upon you.

Product warranties

Some products and services that are offered for sale by Neil Squire Society on this Website may be guaranteed according to the terms of a specific manufacturer’s warranty. Retain all written warranties in case of future adjustment.

Shipping and risk of loss

If Neil Squire Society has your products in stock, we will accept your order by emailing you a shipping notice confirming that the items have shipped and are en-route to you. In-stock orders normally ship within five (5) business days of placing your order, although special delivery items will ship more or less frequently, as outlined in the product shipping details. Out-of-stock orders will ship once the item is back in stock, and will be shipped to the address you provide to us. We will send you the shipping notice once the item is back in stock and has been shipped. The risk of loss and title for purchased items will pass to you upon our delivery to the carrier.

Neil Squire Society reserves the right to limit the quantities that are available for sale or sold.

Neil Squire Society also reserves the right at any time to reject, correct, cancel or terminate any order for any reason whatsoever in our sole discretion. If the price of any product you order was incorrectly displayed on our website, we will provide you with an opportunity to place an order at the correct price.

Advertisements on our website are invitations to you to make offers to purchase products and services on this website and are not offers to sell. Your properly completed and delivered order form constitutes your offer to purchase the products or services referenced in your order. Your order will be deemed to be accepted only if and when we send a shipping notice email to your email address. That shipping notice email constitutes our acceptance of your order and forms a legally binding contract with Neil Squire Society. If you wish to cancel an order, you may request a cancellation by logging into your account and cancelling your order, by emailing Neil Squire Society at info@makersmakingchange.com, or by calling Neil Squire Society’s customer service representatives at 604-473-9363. However, we may not receive and process your cancellation request before we accept and ship your order, in which case your cancellation request may not be effective. You may cancel any order if the products you purchased are not delivered to you within 30 days after we send a shipping notice email to your email address.

Returns

If for any reason you are not completely satisfied with a product you have purchased, we will gladly give you a full refund (except for certain items described below) or exchange if you return it to #400 – 3999 Henning Drive, Burnaby, BC V5C 6P9 within thirty (30) days after you receive it in its original condition (including all packaging, accessories and manuals). To return your purchased product, please contact Neil Squire Society at info@makersmakingchange.com before shipping back your product and provide your electronic invoice. In the event that a returned order has any packaging, manuals, accessories, blank warranty cards or other items missing, the return may be refused, or we may deduct the value of any of the missing items from your refund. Shipping charges are non-refundable; however, we will refund your original shipping cost if you are returning an item because of an error on our part, or if we have determined that the product is defective.

English language

The parties have requested that these Terms of Use and all documents contemplated hereby be drawn up in English. Les parties aux présentes ont exigé que cette entente et tous autres documents envisagés par les présentes soient rédigés en anglais.

General

You confirm that you are either at least 18 years of age, or possess the consent of your parent or legal guardian, and that you are fully able to enter into the terms, conditions, obligations, representations, and warranties described in these Terms of Use, and to abide by and comply with them.

You agree that the Website shall be deemed to be solely based in British Columbia, Canada and that these Terms of Use shall be governed by the laws of the Province of British Columbia, Canada.  You further agree that the courts of British Columbia, Canada shall have exclusive jurisdiction over any dispute arising from your use of the Website or these Terms of Use. You agree that any cause of action in relation to the Website or these Terms of Use must be commenced within one (1) year after the cause of action accrues, or such cause of action will be permanently barred.
